2. Scope

These terms apply to every order placed on www.elcielicious.com. You accept them when you place an order. The version that applies is the one published on the website at the time of your order. If one provision is invalid, the others remain in force. Your statutory consumer rights always apply; nothing in these terms limits them.

3. Offer and order

You can only order through the online shop, while stocks last. Your order is final when you confirm it at checkout with an obligation to pay. You then receive a confirmation by email. We may refuse an order if we seriously suspect abuse or fraud, or if a product is out of stock; in that case you pay nothing or are refunded immediately.

4. Prices and payment

All prices are in euros and include VAT. Shipping costs are added and are always shown at checkout, before you pay.

You pay in advance using one of the payment methods shown at checkout: via Shopify Payments (including Bancontact, Visa, Mastercard, Maestro, Apple Pay and Google Pay), PayPal or Klarna. Klarna's own terms also apply when you pay with Klarna.

5. Discounts and newsletter

When you subscribe to our newsletter, you receive a one-time 10% discount code for your next order. Discount codes cannot be combined or exchanged for cash unless stated otherwise. You can unsubscribe at any time via the link in every newsletter.

6. Gift cards

Gift cards can only be used in our online shop, are not reloadable and cannot be exchanged for cash.

7. Delivery and pick-up

We process orders within 1–2 business days and ship with DPD and PostNL (via MyParcel). Delivery to Belgium, the Netherlands, Germany, France and Luxembourg usually takes 1–3 business days after dispatch. Shipping to Belgium costs €6.99 and is free from €65; to the Netherlands it costs €7.99 and is free from €75. Rates for other countries are listed in our shipping policy. Pick-up in Wetteren is possible by appointment.

If we do not deliver within 30 days of your order (or within the agreed period), you may cancel the order and we will refund the full amount immediately. Risk in the products passes to you only when you (or a person you designate) receive the parcel.

8. Right of withdrawal (14 days)

As a consumer, you may withdraw from your purchase without giving a reason within 14 calendar days of receipt (Art. VI.47 to VI.52 of the Belgian Code of Economic Law). Let us know via info@elcielicious.com or with the model form in our refund policy, and return the products no later than 14 days after notifying us. Return shipping costs are yours, unless we delivered a wrong or damaged product.

Exceptions (Art. VI.53 CEL): goods that are liable to deteriorate or expire rapidly (4°) and food products that were unsealed or opened after delivery and cannot be returned for health protection or hygiene reasons (5°). Unopened, non-perishable products in their original, undamaged packaging can be returned.

We refund the purchase price and the original standard shipping costs within 14 days of your withdrawal, using the same payment method. We may wait until we have received the products back or you have shown proof of return.

9. Legal guarantee and complaints

You are entitled to the 2-year statutory guarantee of conformity (Art. 1649bis et seq. of the former Belgian Civil Code). For food products, the guarantee naturally applies within the best-before/use-by date. Report any defect, damage or incorrect delivery as soon as possible and at the latest within 2 months of discovering it, preferably with a photo, to info@elcielicious.com. We will then find a solution together: replacement or refund.

Send complaints to info@elcielicious.com; we reply within 5 business days. If we cannot resolve it together, you can contact the Belgian Consumer Mediation Service (consumentenombudsdienst.be, Boulevard du Roi Albert II 8 box 1, 1000 Brussels). For cross-border disputes you can also contact the European Consumer Centre Belgium (eccbelgium.be).

10. Liability and force majeure

We do our best to keep the information on the website accurate and up to date. To the extent permitted by law, we are not liable for indirect damage or force majeure (such as carrier strikes, natural disasters or third-party outages). This limitation does not apply in case of intent, gross negligence or personal injury, and never affects your statutory guarantee.

11. Privacy and cookies

We process your personal data in accordance with the GDPR. See our privacy policy, with cookie information in section 9 Cookies.

12. Intellectual property

Texts, photos and designs on this website are protected. You may not use them commercially without our permission.

13. Governing law and jurisdiction

These terms and your order are governed by Belgian law. As a consumer, you retain the protection of the mandatory rules of your country of residence. Disputes fall under the courts of the judicial district of East Flanders (Ghent division), without prejudice to your right as a consumer to bring proceedings before the courts of your place of residence.

In case of discrepancy, the Dutch version prevails, without prejudice to your mandatory consumer rights.
